Terms of Service

These Terms of Service ("Terms") govern your use of gmcfixer.us and any services purchased from GMC Fixer, a sole proprietorship owned by Paul N. Mangiafico, Jr., 162 Brook St, #2, Manchester, NH 03104, United States ("GMC Fixer", "we", "us"). By purchasing or using our services you ("Client") agree to these Terms.
1. Services
GMC Fixer provides consulting services related to Google Merchant Center compliance, including a review of your website, policies, checkout and product feed; a written report of identified issues with recommended fixes; and preparation of, and guidance on, a review request (appeal) to Google. The scope of each purchase is described on the pricing section of our website at the time of purchase.
2. No affiliation with Google
GMC Fixer is an independent consultancy. We are not affiliated with, endorsed by, or acting on behalf of Google LLC. Google, Google Merchant Center and Google Shopping are trademarks of Google LLC, used here only to describe the services we provide.
3. No guarantee of outcome
We work to identify and resolve every compliance issue we find and to maximize your chance of approval. However, Google retains sole and final authority over account reviews, suspensions and reinstatements. We do not and cannot guarantee that any account will be reinstated or that any review will be completed within a particular time.
4. Client responsibilities
You agree to provide accurate and complete information about your business, to grant the account access we reasonably request, and to implement recommended changes or authorize us to do so. You remain solely responsible for the content of your website, your products, your business practices and your compliance with all laws and Google policies. We will not knowingly help present false or misleading information to Google.
5. Fees and payment
Fees are stated in US dollars and are due in full at the time of purchase. Payments are processed by third party payment processors. Cancellations and refunds are governed by our Refund & Cancellation Policy.
6. Delivery
We aim to deliver the audit report within 3 business days of receiving the required access and information. Deliverables are sent by email to the address provided at purchase.
7. Confidentiality
We treat your account data, store information and business details as confidential and use them only to perform the services. We will not disclose them to third parties except as required by law or as described in our Privacy Policy.
8. Intellectual property
Upon full payment you receive a perpetual, non transferable license to use the reports and appeal drafts we deliver for your own business. Our methods, checklists, templates and website content remain the property of GMC Fixer.
9. Limitation of liability
To the fullest extent permitted by law, GMC Fixer is not liable for indirect, incidental, special or consequential damages, including lost profits, lost revenue or lost advertising opportunity. Our total liability for any claim relating to the services is limited to the amount you paid for those services.
10. Indemnification
You agree to indemnify and hold GMC Fixer harmless from claims arising from your products, your website content, inaccurate information you provide, or your violation of any law or third party policy.
11. Termination
Either party may end an engagement by written notice. We may decline or end an engagement if we reasonably believe the Client's business involves prohibited products, fraud or deceptive practices; any refund in that case follows the Refund & Cancellation Policy.
12. Governing law
These Terms are governed by the laws of the State of New Hampshire, United States, without regard to conflict of law rules. Disputes will be resolved in the state or federal courts located in Hillsborough County, New Hampshire.
13. Changes and contact
